Terms & Conditions

These Terms & Conditions apply to purchases made through Young Gun of Wine, including Young Gun of Wine CURATED memberships, Deep Dive packs, Collaboration wines and any other products or services made available through our website from time to time.

By placing an order, paying a deposit, joining a membership or otherwise purchasing from Young Gun of Wine, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions limits any rights you may have under the Australian Consumer Law or any other law that cannot be excluded.

1. About us

In these Terms & Conditions, “Young Gun of Wine”, “YGOW”, “we”, “us” and “our” refer to Young Gun of Wine Pty Ltd. “You” and “your” refer to the customer placing an order, paying a deposit, joining a membership or otherwise purchasing from us.

2. Important things to know

These Terms & Conditions include important information about:

alcohol sales and age requirements;
recurring monthly billing for Young Gun of Wine CURATED memberships;
deposit-based orders for Deep Dive packs, Collaboration wines and other offers;
when orders can be updated, paused or cancelled;
when deposits are non-refundable;
delivery, age verification and failed deliveries;
substitutions, availability and cancellations;
your rights under the Australian Consumer Law.

In particular:

Young Gun of Wine CURATED is a monthly membership. It is billed on the 7th of each month.
You can update, pause or cancel your CURATED membership at any stage up until 11:59pm on the 6th of that month. Changes made by that cut-off apply to that month’s order.
After 11:59pm on the 6th, your CURATED monthly order is locked in for billing and delivery.
CURATED monthly packs are expected to ship approximately two weeks after the billing date.
Deep Dive packs and Collaboration wines may be sold by deposit.
Deposits are non-refundable for change of mind, but will be refunded if Young Gun of Wine cancels the relevant deposit-based offer before fulfilment, or where required by law.
Some packs and offers are curated, limited, allocated, pre-ordered or not fully finalised at the time you pay.
Wine is subject to availability and suitable substitutions may occur.
If your order arrives damaged, faulty or incorrect, please contact us as soon as possible.

3. Alcohol licence and warning notice

Young Gun of Wine supplies alcohol under Victorian Remote Seller’s Licence No. 36313419.

Warning: Under the Liquor Control Reform Act 1998, it is an offence to supply alcohol to a person under 18 years. Penalties apply. It is also an offence for a person under 18 years to purchase or receive alcohol. Penalties apply.

You must be 18 years or older to purchase alcohol from us. Alcohol must not be supplied to, purchased by, delivered to or received by anyone under 18 years of age.

Our liquor licence number will be displayed on our website or ordering platform and, where required, in advertisements or promotions for alcohol delivery or pickup.

4. Alcohol sales and age requirements

By placing an order, paying a deposit, joining a CURATED membership or otherwise purchasing alcohol from us, you confirm that:

you are at least 18 years of age;
the person receiving the delivery will be at least 18 years of age;
you will not supply alcohol purchased from us to anyone under 18 years of age; and
the information you provide to us is true and accurate.

We may refuse, cancel or refund an order if we reasonably believe the order has been placed by, or is intended for delivery to, a person under 18 years of age.

Delivery partners may require proof of age at delivery. If proof of age cannot be provided, the delivery may not be completed.

Delivery may also be refused if the recipient appears intoxicated, if there is a substantial risk that the recipient is intoxicated, if the delivery partner reasonably believes the alcohol may be supplied to a person under 18, or if delivery would breach applicable liquor laws or carrier requirements.

5. Product availability

All products are offered subject to availability.

Wine is a limited agricultural product and some wines may be available only in small quantities. We may need to substitute a wine, delay fulfilment or cancel an order if a wine becomes unavailable, damaged, unsuitable for dispatch or otherwise unable to be supplied.

Where a specific wine is unavailable and a suitable substitution is possible, we may substitute a wine of equal or greater value and similar style.

Where we cannot supply the product ordered, or a suitable alternative, we will contact you and may offer a replacement, credit or refund, depending on the circumstances.

6. Pricing

All prices are shown in Australian dollars.

Unless otherwise stated, prices include GST.

Prices may change from time to time. Any price change will not affect an order that has already been accepted and paid for, unless the change is required by law or you agree to the change.

Delivery costs, where applicable, will be shown at checkout before you place your order.

7. Pricing, product and website errors

We take reasonable care to ensure that product descriptions, prices, deposit amounts, discounts, delivery charges and availability information are accurate.

However, errors may occur.

If a product, price, deposit, discount, delivery charge, description or availability status is listed incorrectly due to error, we may contact you to confirm whether you wish to proceed at the correct price or on the corrected terms.

If you do not wish to proceed, or if we cannot reasonably fulfil the order, we may cancel the order and refund any amount paid for that cancelled order.

8. Order details

You are responsible for checking your order details before placing an order.

This includes checking:

the products or services selected;
quantities;
delivery address;
billing details;
contact details;
CURATED membership preferences;
deposit and balance payment terms;
delivery restrictions; and
any other information shown at checkout.

We are not responsible for delays, failed deliveries or additional costs caused by incorrect or incomplete information provided by you.

9. Young Gun of Wine CURATED memberships

Young Gun of Wine CURATED memberships are monthly wine memberships.

A CURATED membership includes three bottles, delivered monthly for $99, unless otherwise stated.

Your CURATED membership is billed on the 7th of each month.

You can update, pause or cancel your membership at any stage up until 11:59pm on the 6th of that month. Changes made by that cut-off will apply to that month’s order.

After 11:59pm on the 6th, your monthly order is locked in for billing and delivery.

CURATED monthly packs are expected to ship approximately two weeks after the billing date. You will receive a shipping notification and tracking details once your wines have been dispatched.

Delivery timeframes are estimates only and may vary depending on fulfilment timing, carrier performance, weather, public holidays, delivery location and other circumstances outside our control.

10. CURATED membership billing

By joining a CURATED membership, you authorise us to charge your nominated payment method monthly for your membership, unless and until your membership is paused or cancelled in accordance with these Terms & Conditions.

The monthly billing date is the 7th of each month.

If payment fails, we may attempt to process the payment again. If we are unable to process payment, we may delay, suspend or cancel the relevant order or membership.

You are responsible for keeping your payment details up to date.

11. CURATED membership updates, pauses and cancellations

You can update, pause or cancel your CURATED membership through your account, or by contacting us, at any stage up until 11:59pm on the 6th of the month.

Changes made by 11:59pm on the 6th will apply to that month’s order.

Changes made after 11:59pm on the 6th will apply to the following month’s order.

After the monthly cut-off, your order is locked in for billing and delivery. Once an order is locked in, we allocate wine and commit to related costs. For this reason, we cannot cancel that month’s order after the monthly cut-off.

This does not affect your rights under the Australian Consumer Law.

12. Changes to CURATED membership terms

We may change the price, billing date, monthly cut-off date, dispatch timing, membership inclusions or other operational details of Young Gun of Wine CURATED memberships from time to time.

If we make a material change to your CURATED membership, we will give you reasonable notice before the change applies.

If you do not agree to a material change, you may update, pause or cancel your membership before the change takes effect.

A material change will not affect a CURATED monthly order that has already been locked in for billing and delivery, unless the change is required by law or is otherwise necessary to fulfil that order.

13. CURATED membership price changes

If we change the price of a CURATED membership, we will give you reasonable notice before the new price applies.

If you do not agree to the new price, you may pause or cancel your membership before your next monthly order is locked in.

A price change will not affect a CURATED monthly order that has already been locked in for billing and delivery.

14. CURATED membership wine selection

CURATED memberships are designed as curated wine selections. We select wines for you based on the membership format you choose, your preferences, availability and our own tasting and editorial judgement.

You may be invited to provide feedback on wines you receive. Feedback helps us refine future selections, but we cannot guarantee that every future delivery will match every stated preference.

The exact wines in each CURATED delivery may vary between members and from month to month.

Wine is subjective, and receiving a wine that is not to your personal taste does not, by itself, mean the wine is faulty or that you are entitled to a refund. This does not affect your rights under the Australian Consumer Law.

15. Deep Dive Packs

Deep Dive Packs are mixed wine packs assembled around a particular Young Gun of Wine Deep Dive topic, such as Nebbiolo, Tasmanian Pinot Noir or another featured theme.

Unless stated otherwise, Deep Dive packs are typically three-bottle packs.

Deep Dive packs are usually sold using a deposit system. When you place an order, you pay the deposit amount stated at checkout. The remaining balance will be charged to your nominated payment method when the pack is finalised and ready for billing and dispatch.

The exact wines in a Deep Dive pack may not be known at the time you pay your deposit. By ordering a Deep Dive pack, you acknowledge that:

the pack will be curated by Young Gun of Wine;
the final wines may be selected after deposits have been taken;
the wines will be chosen based on the relevant Deep Dive topic, availability, allocation and our editorial judgement; and
the final pack may vary from any examples, themes or indicative descriptions shown at the time of deposit.

We will determine the final wines for a Deep Dive pack after considering factors such as the number of orders received, wine availability, allocation capacity, producer supply and the conclusion of the relevant sales period.

When the Deep Dive pack is finalised, we will charge the remaining balance to your nominated payment method and arrange dispatch.

16. Collaboration Wines

Collaboration Wines are wines offered by Young Gun of Wine in collaboration with one or more winemakers, producers or partners.

Collaboration Wines may include exclusive wines, limited releases, special projects, mixed packs or other collaborative wine offers.

Collaboration Wines may be sold using a deposit system. When you place an order, you pay the deposit amount stated at checkout. The remaining balance will be charged to your nominated payment method when the Collaboration wine or pack is finalised and ready for billing and dispatch.

The exact structure of each Collaboration offer may vary. Some Collaboration offers may identify the precise wine or wines at the time of deposit. Others may provide a broader description of the project, producer, style, format or expected contents.

The product page for each Collaboration offer will set out the key details known at the time of purchase.

By paying a deposit for a Collaboration wine, you acknowledge that:

the project may be limited in quantity;
the final wine, pack format, dispatch date or other details may depend on production, allocation, market demand or producer supply;
your deposit helps us determine whether there is sufficient demand to proceed with the project; and
the remaining balance will be charged to your nominated payment method when the offer is finalised and ready for dispatch.

17. Deposits, pre-orders and future payments

Some Young Gun of Wine products and services may be offered by deposit, pre-order or other staged payment arrangement.

Where this applies, the product page or checkout will state the deposit amount, any remaining balance payable, and when we expect to charge that remaining balance.

By paying a deposit or placing a pre-order, you authorise us to securely store your nominated payment method through our payment provider and charge the remaining balance when the relevant product, pack, wine or service is finalised for billing, fulfilment or delivery.

This may apply to Deep Dive packs, Collaboration wines or other products and services offered from time to time.

Deposits are non-refundable for change of mind. This means that, once you have paid a deposit, you cannot cancel your order simply because you have changed your mind, no longer want the product, or do not wish to proceed with the remaining payment.

If Young Gun of Wine cancels a deposit-based offer before fulfilment, you will receive a refund of the deposit paid for that cancelled offer.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

18. Failed final payments for deposit-based orders

If we cannot process the remaining balance for a deposit-based order, we may contact you for updated payment details.

If payment is not completed within a reasonable time, we may cancel your order and release the allocation.

If your order is cancelled because you do not complete the remaining payment, your deposit remains non-refundable for change of mind, unless otherwise required by law.

19. Cancellation of Deep Dive packs, Collaboration wines or deposit-based offers by us

If we cancel a Deep Dive pack, Collaboration wine or other deposit-based offer before fulfilment, you will receive a refund of the deposit you paid for that cancelled offer.

Reasons we may cancel a deposit-based offer include, but are not limited to:

insufficient demand;
insufficient wine availability;
producer supply issues;
quality concerns;
shipping or fulfilment issues;
allocation constraints;
regulatory or licensing issues;
technology, payment or website issues; or
circumstances outside our reasonable control.

If we cancel an offer, we may, where appropriate, invite you to transfer your deposit to another offer, receive store credit or receive a refund. You are not required to accept store credit or an alternative offer if we have cancelled the original offer.

20. Customer cancellations for Deep Dive Packs, Collaboration Wines and deposit-based offers

Deposits are non-refundable for change of mind.

Because Deep Dive packs, Collaboration wines and other deposit-based offers may be limited, allocated, pre-ordered or commissioned based on customer demand, you cannot cancel a deposit-based order simply because you have changed your mind, no longer want the product, or do not wish to proceed with the remaining payment.

If you believe there is an issue with your order, please contact us as soon as possible.

This does not affect your rights under the Australian Consumer Law.

21. Delivery

We deliver to Australian addresses only, unless otherwise stated.

Customers may place orders at any time. Alcohol may only be packed, fulfilled and delivered during the hours permitted by our liquor licence and applicable liquor laws.

Delivery timeframes are estimates only. We will use reasonable efforts to dispatch orders promptly, but delivery times may be affected by carrier delays, weather, public holidays, peak periods, producer delays, stock availability, incorrect address details or other circumstances outside our control.

You are responsible for providing accurate delivery information.

Where a delivery is returned to us because of incorrect address details, failed delivery attempts, refusal of delivery, inability to verify age, failure to collect from a pickup point or other reason caused by you, we may contact you to arrange redelivery. Additional delivery fees may apply.

22. Alcohol delivery timing and legal restrictions

Alcohol deliveries are subject to liquor laws, carrier requirements and our licence conditions.

Customers may place orders at any time, but alcohol may only be packed, fulfilled and delivered during the hours permitted by our liquor licence and applicable liquor laws.

Alcohol must not be delivered to a person who is under 18 years of age, intoxicated, or where there is a substantial risk that the person is intoxicated.

Delivery may be refused if proof of age cannot be provided, if the recipient appears intoxicated, if there is a substantial risk the recipient is intoxicated, if the delivery would breach liquor laws, or if the delivery cannot be completed in accordance with carrier requirements.

23. First-time, repeat and gift deliveries

For first-time customer orders, delivery may need to be made to the person who placed the order, and proof of age may be required on delivery.

For repeat customer orders, delivery may be completed in accordance with the delivery instructions you provide, subject to liquor laws and carrier requirements.

For gift orders, you must provide the recipient’s name and delivery address and confirm that both you and the recipient are 18 years or older. The delivery partner may require the recipient, or another person aged 18 or older at the address, to provide proof of age before handing over the alcohol.

24. CURATED address changes

For CURATED memberships, address changes made before 11:59pm on the 6th of the month will apply to that month’s order.

Address changes made after 11:59pm on the 6th may not apply until the following month’s order.

If you need to change your delivery address after the monthly cut-off, please contact us as soon as possible. We will try to assist where possible, but we cannot guarantee that the address can be changed after the monthly cut-off or after fulfilment has commenced.

Once an order has been dispatched, delivery redirection is subject to carrier rules and may not be available. Any redirection, redelivery or related carrier costs may be your responsibility.

25. Delivery restrictions and dry zones

We do not deliver to areas where alcohol delivery is prohibited or restricted by law, including dry zones, restricted communities or other addresses where alcohol delivery cannot lawfully be completed.

We may refuse, cancel or refund an order where we cannot legally deliver alcohol to the nominated address.

Some states and territories may have additional liquor delivery restrictions, minimum pricing rules, delivery time restrictions or other legal requirements. Your order may be refused, delayed, amended or cancelled where necessary to comply with applicable laws.

26. Authority to leave

Alcohol deliveries may be subject to age verification, delivery restrictions and carrier requirements.

We cannot guarantee that alcohol will be left unattended, even if you provide authority to leave. A carrier may refuse to leave alcohol unattended or may require proof of age at delivery.

If unattended delivery is available and you request or authorise it, responsibility for the order may pass once the carrier records the order as delivered to the address you provided, subject to your rights under the Australian Consumer Law.

Alcohol must not be delivered to, accepted by or supplied to anyone under 18 years of age.

27. Failed delivery and non-collection

If delivery cannot be completed because of incorrect delivery details, no access, refusal of delivery, failure to provide proof of age, suspected unlawful supply, failure to collect from a pickup point, or any other reason caused by you or the recipient, we may:

arrange redelivery;
ask you to provide updated delivery information;
charge additional delivery or handling costs;
return the order to us;
cancel the order; or
refund the order less costs reasonably incurred, where permitted by law.

If an order is returned to us and you do not respond to our attempts to contact you within a reasonable time, we may cancel the order and refund any amount required by law, less any delivery, return, handling or other costs reasonably incurred.

28. Failed alcohol delivery records

If an alcohol delivery is refused or cannot be completed because of age-verification requirements, intoxication, substantial risk of intoxication, unattended delivery restrictions, failure to provide acceptable proof of age or other liquor-law requirements, we or our delivery partners may record information about the failed delivery.

This may include the date and time of the refusal, the delivery postcode, the reason for refusal, delivery status and other information reasonably required for compliance, customer service, delivery administration and reporting obligations.

Personal information will be handled in accordance with our Privacy Policy.

29. Delivery records and proof of delivery

Our delivery partners may record delivery information, including delivery status, recipient name, proof of age, proof of delivery, photographs, GPS or location data, signatures or other delivery records.

This information may be used for delivery, administration, dispute resolution, customer service, compliance with liquor laws and proof of delivery.

Personal information will be handled in accordance with our Privacy Policy.

30. Risk and title

Title to products passes to you once we have received full payment for the relevant order.

Risk in the products passes to you when the products are delivered to the delivery address you provided, except where the products are damaged in transit or where your rights under the Australian Consumer Law apply.

31. Damaged, faulty or incorrect products

If your order arrives damaged, faulty or incorrect, please contact us as soon as possible and provide your order number, a description of the issue and photographs where relevant.

We may ask you to retain the affected bottle, packaging or delivery materials while we assess the issue.

Where required under the Australian Consumer Law, we will provide an appropriate remedy, which may include replacement, refund, store credit or another remedy depending on the circumstances.

32. Returns and change of mind

We do not generally accept returns or provide refunds for change of mind, personal taste preference, or because you did not enjoy a particular wine.

Wine is subjective, and curated selections may include varieties, producers, regions or styles that are new to you. This is part of the nature of a curated wine experience.

Deposits are non-refundable for change of mind, unless otherwise required by law.

This does not affect your rights under the Australian Consumer Law, including your rights where products are faulty, damaged, unsafe, incorrectly described or otherwise fail to meet a consumer guarantee.

33. Heat, weather and shipping conditions

Wine is sensitive to heat, cold and handling conditions.

We may delay dispatch during periods of extreme weather or carrier disruption if we consider that delay is reasonably necessary to protect the wine.

We are not responsible for deterioration caused by your failure to collect wine promptly, incorrect delivery details, redirection delays requested by you, or wine being left unattended after delivery in unsuitable conditions.

34. Heavy boxes and safe handling

Wine boxes may be heavy. Please take care when lifting, carrying or moving deliveries.

35. Vintages, bottle images and product descriptions

Bottle images, labels, vintages and product descriptions are provided for general guidance.

From time to time, a product image may show a different vintage, label or packaging format from the wine supplied. Where vintage is material to the offer, we will aim to identify it clearly.

For curated packs, Deep Dive packs, Collaboration wines and other limited offers, descriptions may be thematic or indicative rather than a guarantee of the exact final wines, unless the product page expressly identifies specific wines.

36. Allergens and responsible consumption

Wine may contain allergens, including sulphites, and may be produced using fining agents or other winemaking inputs.

Please check product information carefully and contact us before ordering if you have specific allergy concerns.

We support the responsible consumption of alcohol.

37. Retail limits and anti-resale

We may limit quantities available per customer, household, address, account or order.

We may refuse, cancel or limit orders where we reasonably believe products are being purchased for resale, are in breach of offer limits, involve misuse of a promotion, or would prevent fair access to limited releases.

If we cancel an order under this section, we will refund any amount paid for the cancelled products, unless otherwise permitted by law.

38. Promotions, discounts and credits

Promotional codes, discounts, credits and special offers may be subject to additional terms.

Unless stated otherwise, promotions cannot be applied retrospectively, exchanged for cash, reused, transferred, combined with other offers or applied to previous orders.

Promotions may exclude memberships, deposits, gift cards, Deep Dive packs, Collaboration wines, limited releases or other products and services unless expressly stated.

We may withdraw or amend promotions at any time, provided this does not affect orders already placed and accepted.

39. Gift orders

If you purchase wine as a gift, you are responsible for ensuring the recipient is at least 18 years of age and able to receive alcohol at the delivery address.

For gift orders, you must provide the recipient’s name and delivery address and confirm that both you and the recipient are 18 years or older.

The delivery partner may require the recipient, or another person aged 18 or older at the address, to provide proof of age before handing over the alcohol.

Gift messages may be included where available, but we reserve the right to refuse messages that are offensive, unlawful or inappropriate.

40. Service communications

When you place an order, pay a deposit, join a membership or otherwise purchase a product or service from Young Gun of Wine, we may send you service-related communications about that purchase.

These may include order confirmations, deposit confirmations, balance payment reminders, billing notices, failed payment notices, shipping notifications, tracking details, delivery updates, account notices, product availability updates, customer service messages and other information reasonably necessary to manage your order, membership or purchase.

These service communications are separate from marketing communications.

You may unsubscribe from marketing communications at any time. However, even if you unsubscribe from marketing, we may still send you service-related communications that are necessary to process, manage or deliver an order, membership or other purchase you have made with us.

41. Marketing communications

If you subscribe to our marketing communications, we may send you emails, SMS messages or other communications about Young Gun of Wine, wine offers, editorial, events, products, services and promotions.

You can unsubscribe from marketing communications at any time by using the unsubscribe facility in the relevant message or by contacting us.

Unsubscribing from marketing communications does not stop service-related communications that are necessary to manage your order, membership or purchase.

42. Account information

You are responsible for maintaining the confidentiality of your account login details and for activity under your account.

You must ensure your account details, delivery address, contact details and payment information are accurate and up to date.

If you believe your account has been accessed without authorisation, please contact us as soon as possible.

43. Payment security

Payments are processed through third-party payment providers.

We do not store full credit card details on our own systems unless expressly stated. Your payment information may be securely stored by our payment provider to allow recurring billing, deposits, pre-orders or future authorised payments.

You authorise our payment provider to store and process your payment details for the purposes described in these Terms & Conditions and at checkout.

44. Privacy collection notice

We collect personal information to process orders, manage memberships, arrange delivery, verify age where required, process payments, provide customer service, manage accounts, administer deposits and pre-orders, improve our services, and send marketing communications where permitted.

We may disclose personal information to third parties who help us provide our products and services, including payment processors, fulfilment providers, delivery partners, technology providers, customer service systems, email and SMS platforms, professional advisers and regulatory authorities where required.

For CURATED memberships, we may also collect and use information about your wine preferences, ratings and feedback to help curate future selections.

We handle personal information in accordance with our Privacy Policy.

45. Customer feedback, reviews and user content

You may be invited to provide feedback, ratings, reviews, comments, photographs, testimonials or other content.

Feedback you provide through your account or My Cellar in relation to CURATED wines is used to help us curate future selections. We will not publish personally identifiable private palate feedback without your permission.

If you submit public reviews, comments, testimonials, photographs, social media content or other public-facing content to us or tag us in public content, you grant Young Gun of Wine permission to use, reproduce, publish, edit and share that content in connection with our business, including on our website, social media, emails, advertising and promotional materials, unless you tell us otherwise.

You must not submit content that is unlawful, misleading, defamatory, offensive, infringing, abusive, discriminatory, obscene, spam, malicious or otherwise inappropriate.

We may moderate, edit, refuse or remove user content at our discretion.

46. Website and account use

You must not misuse our website, account systems or services.

You must not:

interfere with the security or operation of our website;
attempt to gain unauthorised access to accounts, systems or data;
introduce malicious code, viruses or harmful material;
scrape, copy or harvest website content or customer information without permission;
use our website for unlawful, fraudulent or misleading purposes;
impersonate another person;
submit false, misleading or incomplete information; or
use our website in a way that may harm Young Gun of Wine, our customers, our partners or our systems.

We may suspend or terminate access to your account if we reasonably believe you have breached this section.

47. Intellectual property

All content on our website and in our communications, including text, images, logos, design, graphics, video, audio, editorial content and trade marks, is owned by or licensed to Young Gun of Wine unless otherwise stated.

You may use our website for personal, non-commercial purposes only.

You must not reproduce, copy, adapt, distribute, publish, communicate or commercially exploit our content without our permission, except as permitted by law.

48. Third-party links and services

Our website may contain links to third-party websites, platforms, payment providers, delivery services or other services.

We are not responsible for third-party websites, platforms, services, content, policies or practices.

Your use of third-party services may be subject to separate terms and conditions.

If you do not agree to a material change affecting your CURATED membership, you may pause or cancel your membership before the next monthly cut-off.
