1   Your rights in relation to privacy

V-Know Pty Ltd (ACN 135 523 152) trading as Young Gun of Wine (YGOW) and Wine Guns for Hire (WGFH) (together, V-Know) understands the importance of protecting the privacy of an individual’s personal information. This policy sets out how V-Know aims to protect the privacy of your personal information, your rights in relation to your personal information managed by V-Know and the way V-Know collects, holds, uses and discloses your personal information.

In handling your personal information, V-Know complies with the Privacy Act 1988 (Cth) (Privacy Act), the 13 Australian Privacy Principles in the Privacy Act and all relevant Australian privacy laws.

This policy may be updated from time to time.

2   What kinds of personal information do we collect?

Personal information is information or an opinion about an identified, or reasonably identifiable, individual. During the provision of its services (including services provided through our WGFH online jobs portal), or undertaking its functions and activities, V-Know may collect your personal information.

Generally, the kinds of personal information V-Know collects are:

(a) contact and identification information such as your name, address, telephone number and email address;

(b) where you are acting on behalf of another entity (whether as an employee, director or other representative), details of that entity and your relationship with it;

(c) where you are making a purchase with us or we are otherwise transacting with you, banking details and financial information as required for V-Know’s functions and activities;

(d) where you are a job candidate at WGFH, your contact details, resume and cover letter and related information you may provide us or other entities through our jobs portal;

(e) where you are an employer at WGFH, information relating the ownership structure of the relevant employer entity including names and addresses of directors and employees and officers that interact with us through our jobs board portal;

(f) other information required for V-Know’s functions and activities.

In some circumstances V-Know may also hold other personal information provided by you.

3   How do we collect personal information?

Generally, V-Know collects your personal information directly from you, through our WGFH online jobs portal, the completion of an online form, an interaction or exchange in person or by way of telephone, email, post or through the use of the YGOW website.

There may be occasions when V-Know collects your personal information from other sources such as from:

(a) a person or entity you represent (such as a contractor or supplier to YGOW or WGFH), where necessary for V-Know to provide its products or services to that entity through you or where necessary for that entity to supply products or services to V-Know;

(b) an Australian government department or agency;

(c) an information services provider;

(d) a publicly maintained record or other publicly available sources of information including social media and similar websites;

(e) if for recruitment purposes, an external recruitment, labour hire, or background screening services provider or third parties with whom you have previously worked.

Generally, V-Know will only collect your personal information from sources other than you if it is unreasonable or impracticable to collect your personal information from you.

4   Why do we need your personal information?

V-Know collects, holds, uses and discloses your personal information where it is reasonably necessary for the purposes of:

(a) providing services through WGFH to an entity/employer that has engaged us to list and promote job listings for employment opportunities in the wine industry, via our online jobs board portal;

(b) providing the services you have requested, ordered or purchased from V-Know including:

(i) to provide the services to you or the organisation you represent;
(ii) to respond to any inquiries, feedback or complaints made by you;
(iii) for invoicing purposes;

(c) enabling V-Know to promote its services to you;

(d) assisting V-Know to improve its services;

(e) processing and assessing employment applications through WGFH for current and future positions;

(f) otherwise managing V-Know’s internal business operations and processes; and

(g) any other legal requirements.

V-Know may also use your personal information for purposes related to the above purposes and for which you would reasonably expect V-Know to do so in the circumstances, where you have consented, or the use is otherwise in accordance with law.

Where personal information is used or disclosed, V-Know takes steps reasonable in the circumstances to ensure it is relevant to the purpose for which it is to be used or disclosed. You are under no obligation to provide your personal information to V-Know. However, without certain information from you, V-Know may not be able to provide its products and/or services to you.

5   To whom do we disclose your personal information?

V-Know discloses your personal information for the purpose for which V-Know collects it. That is, generally, V-Know will only disclose your personal information for a purpose set out at paragraph 4. This may include disclosing your personal information to:

(a) Australian government agencies and departments;

(b) third parties engaged to perform administrative or other business management functions, including debtor management, mailing houses, financial institutions, and web-hosting organisations;

(c) V-Know’s professional advisors, agents, contractors, consultants and related bodies corporate;

(d) regulatory bodies if and as necessary.

V-Know’s disclosures of your personal information to third parties are on a confidential basis and/or otherwise in accordance with law. V-Know may also disclose your personal information with your consent or if disclosure is required or authorised by law.

V-Know does not disclose personal information to overseas recipients. V-Know does not sell your data or personal information under any circumstances.

6   Direct marketing

V-Know may use and disclose your personal information in order to inform you of products and services that may be of interest to you. In the event you do not wish to receive such communications, you can opt-out by contacting V-Know via the contact details set out in paragraph 9 or through any opt-out mechanism contained in a marketing communication to you.

7   Security of your personal information

V-Know takes steps reasonable in the circumstances to ensure that the personal information it holds is protected from misuse, interference, and loss and from unauthorised access, modification, or disclosure. V-Know holds personal information in secure databases on secure premises, accessible only by authorised staff.

V-Know will destroy or de-identify personal information in circumstances where it is no longer required, unless V-Know is otherwise required or authorised by law to retain the information.

8   Access and correction to personal information that we hold about you

V-Know takes steps reasonable in the circumstances to ensure personal information it holds is accurate, up-to-date, complete, relevant and not misleading. Under the Privacy Act, you have a right to access and seek correction of your personal information that is collected and held by V-Know. If at any time you would like to access or correct the personal information that V-Know holds about you, or you would like more information on V-Know’s approach to privacy, please contact V-Know using the details set out in paragraph 9 below.

V-Know will grant access to the extent required or authorised by the Privacy Act or other law and take steps reasonable in the circumstances to correct personal information where necessary and appropriate.

To obtain access to your personal information:

(a) you will have to provide proof of identity to ensure that personal information is provided only to the correct individuals and that the privacy of others is protected;

(b) V-Know requests that you be reasonably specific about the information you require; and

(c) V-Know may charge you a reasonable administration fee, which reflects the cost to V-Know for providing access in accordance with your request.

V-Know will endeavour to respond to your request to access or correct your personal information within 30 days from your request.

9   Cookies

Our website uses ‘cookies’ which are small pieces of information sent from the website and stored by your browser on your computer’s hard drive. Cookies that V-Know uses enable its systems to provide features of its services and allow you to visit its website without re-entering your username and/or password, personalize and improve your experience, including the display of more relevant ads on external websites, and to improve the functionality and user-friendliness of its services and monitor how its website is used through your computer or mobile device.

This information is used by V-Know to improve and tailor its website functionality and better understand how you interact with our services and to monitor aggregate usage and web traffic routing on our website. You can modify your browser setting by editing your browser options to reject our cookies or to prompt you before accepting a cookie. However, if a browser does not accept cookies or if you reject a cookie, some portions of our online services may not function properly.

11   Privacy complaints

Please direct all privacy complaints to V-Know. At all times, privacy complaints:

(a) will be treated seriously;

(b) will be dealt with promptly;

(c) will be dealt with in a confidential manner; and

(d) will not affect your existing obligations or affect the commercial arrangements between you and V-Know.

V-Know will commence an investigation into your complaint. You will be informed of the outcome of your complaint following completion of the investigation. If you are dissatisfied with the outcome of your complaint, you may refer the complaint to the Office of the Australian Information Commissioner.
